Welcome to contourmap.app (the "Service"), operated by contourmap.app ("we," "us," or "our"), a company based in Israel. By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

Our Service provides users with contour maps generated from open-source data. These maps are intended for preliminary design purposes only and are not suitable for engineering or construction use. We do not guarantee the accuracy or completeness of the maps.

3. Use of Service

• Eligibility: You must be at least 18 years old to use the Service.
• Account Registration: Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account information.
• Compliance: You agree to use the Service in compliance with all applicable laws and regulations.

4. User Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Modify, adapt, hack, or reverse engineer the Service.
• Transmit any viruses or any code of a destructive nature.

5. Intellectual Property Rights

All content provided through the Service, including but not limited to maps, graphics, and text, are the property of mapcontour.app or its licensors and are protected by intellectual property laws.

6. Data Accuracy and Open-Source Information

Our Service generates contour maps using open-source data obtained from third-party sources. While we endeavor to use reliable data sources, we cannot guarantee the accuracy, completeness, reliability, or timeliness of the information provided. The open-source data may contain errors, omissions, or may not be up-to-date.

• No Warranty on Data Accuracy: We expressly disclaim any warranties or representations regarding the accuracy or reliability of the maps and data generated through the Service. The maps are provided "as is" for general informational and preliminary design purposes only.
• Not for Engineering or Construction Use: The maps and data are not intended for engineering, construction, or any other applications requiring precise measurements or specifications. Users should not rely on the maps for critical decisions or professional purposes without independent verification.
• User Responsibility: You acknowledge that any reliance on the maps and data is at your own risk. We recommend consulting official sources or professional services for activities that require accurate and reliable data.
• Limitation of Liability: We shall not be held liable for any errors, inaccuracies, or omissions in the data, nor for any actions taken in reliance on the maps generated by the Service.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the accuracy, reliability, or availability of the Service. The maps generated are not intended for engineering or construction purposes.

8. Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Service.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your use of the Service or violation of these Terms.

10. Refund Policy

Refunds will only be issued if the output map provided is corrupted or otherwise unusable. To request a refund, please contact our customer support within 7 days of receiving the corrupted map.

No Refunds will be issued for multi map (voucher) purchases. In case of a corrupted map contact our customer support within 7 days to receive an additional map on your voucher.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions.

12. Single Purchase Contour Map Terms

When you purchase the single item listed as "Contour Map" on the Service, the following terms apply:

• The purchase is valid for a single location and remains active only for the duration of your current browser session.
• The purchase is not a subscription, does not create an account, and will not result in recurring or future charges.
• You may adjust the map’s styling, contour intervals, units, and other available options, and download the resulting files as many times as you wish, in any format offered, for the selected location.
• After payment you may not change the selected location or resize the area boundaries. If you need to modify the area or switch locations after purchase, please consider the Unlimited Plan.

13. Unlimited Plan Terms

Users who purchase an Unlimited Plan receive a unique access code for generating contour maps on the Service, subject to the following terms:

• Fair Use: The Unlimited Plan allows for unlimited use under fair use guidelines. A limit of 20 map generations per day is considered fair use and may be soft-enforced to ensure quality of service for all users.
• Access Code: A unique access code will be provided to the purchaser of the Unlimited Plan. This code grants access to the Service without the need for individual purchases.
• Sharing Restrictions: The access code may be shared with immediate team members (e.g., within the same organization or working group) but may not be shared with unrelated third parties or strangers.
• Prohibited Use: The access code must not be posted publicly online, resold, or transferred to others. Any such behavior may result in suspension or termination of access without refund.
• Educational Use: Students may not share their access code with classmates unless they are actively collaborating on a shared task or project.
• Automation Ban: The access code may not be used in conjunction with any automated systems, including but not limited to scripts, crawlers, or bots.
• Enforcement: Any breach of these terms, including misuse, automation, or unauthorized sharing, will result in immediate cancellation of the Unlimited Plan without refund.
• Non-Refundable: The Unlimited Plan is non-refundable under any circumstances.

14. Data Sources & Licensing

The maps and datasets available through the Service include information obtained from multiple third-party sources, including open-data and commercially licensed providers. We do not own or control these data sources and cannot guarantee their accuracy, reliability, licensing terms, or continued availability.

User Responsibility: Licensing requirements vary by provider and by intended use. You acknowledge that you are solely responsible for reviewing the terms of each data source and ensuring that your use of the maps, exports, and any derived products complies with all applicable licenses, attribution requirements, and legal obligations.

No Legal Guarantee: We make no warranty or representation regarding your rights to use third-party data for commercial, engineering, planning, or any other specific purposes. If you intend to rely on the data for professional or legal use, you must verify accuracy and licensing independently.

15. Changes to the Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of any changes by updating the "Last updated" date at the top of these Terms. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
